A scooter rider was proceeding behind a refuge lorry which intended to turn left at a junction. The scooter overtook the lorry. The refuge lorry was 8’ 4’’ wide and 34’ long so it couldn’t turn in until a waiting Ford Escort had pulled out of the junction.

The car manoeuvred out of the junction and was beyond the front off side of the lorry when a collision occurred with the scooter.

The evidence was that the scooter had been proceeding at speed and the nature of the manoeuvre had been reckless. The car driver had been proceeding slowly and with care and the scooter rider had showed a serious want of care.

Scooter 100% to blame
