David had no opportunity to avoid the collision

David was driving to work in a northerly direction on the B9121 near Banff in Aberdeenshire. The B9139 crosses over the B9121 but David’s intention was to proceed straight on. However, just as he reached the junction travelling at around 35-40mph, suddenly a tractor came from the right and collided with the side of his vehicle.

He had no opportunity to take evasive action. The tractor had a snow plough mounted to the front of it. The force of the collision pushed David’s vehicle off the road. You can see from the images below that the airbags were deployed and the large tyre marks on the grass when his vehicle left the road. You’re unable to see that the left rear tyre was completely ripped off the car.

Driver of the tractor didn’t look

The tractor failed to stop at the give way lines and give way to David who had right of way. The driver of the tractor admitted fault at the scene stating that he did not look in both directions before pulling out and across the crossroads.

The car’s emergency SOS was triggered and all 3 emergency services attended the scene. Astonishingly, David’s injuries were relatively minor in nature considering the extensive damage to his vehicle. He did not require to attend hospital after being checked over at the scene by paramedics. He experienced pain in his back, shoulder and ribs which subsided after receiving pain medication from his GP.

RTA Law intimated a claim on behalf of David to the insurance company of the tractor. Liability was admitted early on, and settlement was agreed seeking an award of compensation for the injuries David sustained together with the policy excess for his vehicle.
